The government announced that it will grant an agreement to the New Zealand Department of Trade and Industry to implement an innovative strategy for creating a new market for over-the-counter Nexium, a generic version of the heartburn medication.

The announcement comes as a major blow to Pfizer, the world's largest drugmaker, which has been vying for a third consecutive quarters- above-average sales of $1.6bn, according to a survey released on Tuesday by the National Center for Health Research (NCHR).

The company announced its decision to halt its commitment to the deal, which had already been in place for more than five years, citing concerns over the impact of the proposed deal on sales.

Pfizer said it would continue to pursue its strategic solutions to expand its business. "We are focused on a key product development strategy that will strengthen the company's position in the market and bring new products to market, particularly for over-the-counter products," Pfizer spokesman Tom McKillop said in a statement.

Pfizer was seeking to build a presence in the U. S., Europe, Asia, Africa, Latin America, Australia, and Canada, as well as in Asia. The company has been looking for new growth opportunities for its U. S. operations since the company's acquisition of a stake in 2004.

"We have been looking into opportunities to expand our U. presence in Canada, Latin America, and Asia," Pfizer said in a statement.

NCHR said it was considering a strategy of strengthening its business and looking for new growth opportunities.

The company said it would have the opportunity to buy over-the-counter Nexium from Pfizer on a cash balance of $500 million, subject to a consideration of $500 million of sales.

Pfizer, which had previously faced a similar deal to launch an over-the-counter version of its heartburn drug, had already completed Phase 3 clinical trials on Nexium, which is expected to start in the fourth quarter of 2005.

Pfizer has been looking for ways to create a market that will allow the company to sell its own generic versions of Nexium, or its branded version, in some countries. The company said it will have the opportunity to expand its U. presence in the U. S., Europe, Asia, Africa, Latin America, and other regions.

The company is seeking a license for its over-the-counter product for its patients, and Pfizer is committed to working with the FDA to allow for marketing approval for its generic product.

Pfizer shares rose 1.4% to $12.50 in trading Tuesday, helped by a 4.1% rise in stock.

NCHR said in a note to investors on Tuesday that the announcement of the agreement was "inconsistently packaged to avoid any possible legal issues with Pfizer."

Under the agreement, Pfizer will be allowed to apply for a license to develop and commercialize its new over-the-counter product. Pfizer is seeking to develop its generic version of Nexium at a lower cost. It will also be able to sell the product, which it will use to treat heartburn. NZDTI also has a license agreement with the New Zealand Government to allow the New Zealand company to apply for a marketing authorization to sell the product in the U. market. NZDTI is a joint venture of the New Zealand company, Pfizer Inc., and the United Kingdom-based Pharmaceutical Alliance.
